Common Types of Military Fraud & Larceny Charges

Fraud and larceny charges related to the U.S. military typically involve theft, deception, or financial manipulation that directly impacts the government, its resources, or personnel. These charges are serious, as they undermine the integrity of military operations and can lead to significant penalties. Here are some common types:

Military Fraud

Military fraud involves intentionally deceiving the government, military personnel, or contractors to obtain money, property, or services unlawfully. Common forms include:

  • False Claims or Billing Fraud: This involves submitting false claims for reimbursement for services or supplies that were not provided, or inflating the value of services or supplies.
  • Contractor Fraud: Companies or individuals working with the military may defraud the government by submitting fake invoices, overcharging for goods or services, or providing substandard products.
  • False Statements or Misrepresentation: Making false statements during procurement processes or while receiving military benefits or compensation, such as lying about injury status to receive disability compensation or making false claims about military experience or qualifications.

Larceny (Theft)

Larceny charges in the military generally involve the unlawful taking of government property or personal property of another person with the intent to permanently deprive them of it. Types include:

  • Theft of Government Property: This includes stealing military equipment, weapons, supplies, or anything that belongs to the government or military operations. Common examples include stealing ammunition, vehicles, or electronics.
  • Theft from Other Service Members: Soldiers, airmen, sailors, or marines may be charged with stealing from fellow service members, such as personal property, cash, or equipment.
  • Peculation (Embezzlement): In cases where military personnel handle government funds, embezzlement may occur if they steal or divert money for personal use, such as taking funds meant for military operations, pay, or welfare programs.

Benefit Fraud

This type of fraud involves illegally obtaining or attempting to obtain military benefits through misrepresentation or deceit. It includes:

  • Military Pay Fraud: Claiming benefits or pay that one is not entitled to, such as falsely reporting dependents, fraudulently claiming allowances, or manipulating military pay systems.
  • Disability Fraud: Submitting false disability claims or exaggerating an injury to receive medical benefits or a disability pension, which is illegal and considered fraudulent.

Social Security and Identity Fraud

This type of fraud involves the unlawful use of social security numbers or personal identification information, often to steal money or benefits from the military or other related entities.

  • Identity Theft: Stealing the identity of another service member or civilian to access benefits or create false documents to receive military-related funds.
  • Social Security Fraud: Illegally using social security numbers to gain access to financial benefits or manipulate payroll.

Misuse of Government Credit Cards

Many military personnel are issued government credit cards for authorized expenses, such as travel, but misuse can lead to charges. Common abuses include:

  • Using the Card for Personal Expenses: Charging personal purchases to the government-issued card, such as hotel stays, meals, or travel unrelated to official duties.
  • Overcharging or False Reporting of Expenses: Fraudulently inflating or misrepresenting the costs associated with official trips or business-related expenditures to pocket the difference.

Bribery and Kickbacks

Military personnel, contractors, or civilian employees may be involved in bribery or kickback schemes. This can involve:

  • Accepting Bribes: Military personnel may accept payments or gifts in exchange for influencing decisions, such as steering contracts to specific companies or allowing violations of military policies.
  • Kickbacks: Contractors or vendors may offer kickbacks to military officials or contractors in exchange for lucrative military contracts or other favoring actions.
